2 Metro workers killed in latest track accident Tuesday, Jan 26, 2010
Two Metro workers were struck and killed by a maintenance vehicle along a track Tuesday.
The men were on a track when they were hit a few blocks from the Rockville Metro Station, Montgomery County Fire and Rescue spokesman Capt. Oscar Garcia said. One worker died at the scene and the other on the way to a hospital, Metro officials said.
Both men were automatic train technicians and the crash involved a large truck equipped to drive on the track when electricity is shut down, according to Metro spokeswoman Angela Gates. The agency said it would release the men’s names after their families were notified.
The deaths occurred at about 1:45 a.m. while the system was closed. The accident disrupted the morning rush for many commuters from Maryland as red line service was shut down between the Shady Grove and Twinbrook stations while the crash was investigated. Shuttles service was being provided between the stations.
The employees who were killed were installing new automatic train control equipment in the track bed. A failure in the automatic train control system, which detects the presence of a train on the track, is believed to have contributed to the June crash. However, Metro spokesman Steven Taubenkibel said the work being done Tuesday morning was routine maintenance.

The trooper involved in the crash was identified as 39-year-old Trooper First Class Kenneth Myers Jr. who is assigned to road patrol duties at the Easton Barracks and has been a member of the Maryland State Police for four years. Myers was driving a 2006 Ford Crown Victoria unmarked Maryland State Police patrol car.

Myers was transported by State Police helicopter to the University of Maryland Shock Trauma Center. All three persons are reported to be in stable condition.

The crash is being investigated by members of the Maryland State Police CRASH Team who will conduct a detailed reconstruction of this collision.
Police say the speed the trooper was traveling prior to the crash has not been determined and will be part of the ongoing investigation. It is not known at this time if the emergency equipment on the patrol car was activated.
Dorchester County State’s Attorney William Jones has been notified about the crash. Police say that when the crash investigation is complete, it will be forwarded to Jones for review regarding charges.

Negligence must not only be asserted but proven if the party claiming to have been hurt is to win the case. To prove negligence the party bringing the action must show that a “reasonable man” would not have behaved in this fashion and therefore the defendant is liable. In this case we have an injury to a man who is in a car hit by a train. The question becomes who is at fault? the driver or the train? If its the driver of the car is at fault (negligent) then his negligence prevents his recovery. This is called contributory negligence. Once the defendant (the train) shows the plaintiff the driver was negligent He will get no money for his injuries.
