Four injured in Gaithersburg collision

Four people were treated at local hospitals after a car struck a curb in a single-vehicle collision Tuesday night in Gaithersburg, police said.

The accident occurred around 10:50 p.m., when the driver hit a curb, sending the SUV into a grassy area near St. Rose of Lima Catholic Church. Subsequently, the vehicle struck a tree and overturned. The collision is under investigation, and it is still unknown why the vehicle struck the curb in the first place.

As a result of the accident, everyone inside the vehicle was taken to the hospital for evaluation. Two have been critically injured: Kendra Frederick (the driver), was taken to the Shock Trauma Center at the University of Maryland Medical Center in Baltimore with life-threatening injuries.

Additionally, the right-rear passenger was also taken to the Baltimore trauma center and is in critical condition. Investigators believe that neither was wearing seat belts.

The front-seat and left-rear passengers were luckier, as they were only treated for injuries and released from local hospitals, police said. Investigators believe both were wearing seat belts.

Two arrested after crash and shoplifting

Two men were arrested after allegedly shoplifting from a Wheaton shopping center. They were trying to flee, when they got into an accident with their stolen getaway car. They are now in custody, facing multiple charges.

In relation to shoplifting charges, the search of the vehicle produced about $7000 worth of property stolen from both JC Penney and Target, according to police. The Ford Exploder had been stolen from Washington, D.C. that morning as well.

But other charges involve a car crash Thursday night at Wheaton Mall. Police say officers saw an Explorer speeding through the parking lot that was endangering pedestrians so they decided to pursue the vehicle.

After they were apprehended, the driver was charged with several counts, including: auto theft and conspiracy to commit auto theft, theft over $1,000, and conspiracy to commit theft over $1,000, unauthorized use of a vehicle and conspiracy to commit unauthorized use of a vehicle, rogue and vagabond, two counts of malicious destruction of property, failure to stop at a red light, reckless driving, speeding, and unsafe lane changing.

There were already outstanding warrants for the driver for commercial burglaries in Montgomery County, Gaithersburg, and Fairfax County.

The passenger was charged with auto theft and conspiracy, theft over $1,000 and conspiracy, unauthorized use of a vehicle, and conspiracy, and two counts of theft under $1,000 and conspiracy.

Both men are being held with bonds: the driver on $50,000, the passenger on $15,000.

Three people injured on RT 50 involving a Maryland State Trooper

Three people were injured in a Dorchester County crash early Tuesday afternoon that involved a Maryland State Police trooper who was conducting traffic enforcement operations.

The trooper involved in the crash was identified as 39-year-old Trooper First Class Kenneth Myers Jr. who is assigned to road patrol duties at the Easton Barracks and has been a member of the Maryland State Police for four years. Myers was driving a 2006 Ford Crown Victoria unmarked Maryland State Police patrol car.

The other car, a 2004 Toyota Avalon, was driven my 75-year-old Majorie MacSorely, 75, of Hurlock. Her daughter, 50-year-old Kathy MacSoreley of Trappe, was a passenger.

Police say a preliminary investigation indicates that shortly after noon Tuesday, Myers was conducting traffic patrol with moving radar on westbound Route 50 west of Vienna, when his radar unit registered an eastbound vehicle exceeding 80 mph. Myers made a u-turn and headed east on Route 50 to stop the vehicle.

Police say that as the trooper’s vehicle approached MD Route 731, the car driven by Marjorie MacSorely, pulled out from Route 731 into the eastbound lanes of Route 50 and the oncoming patrol car. The vehicles collided in the intersection of Rt. 50 and Rt. 731.

Both Marjorie MacSorely and Myers were trapped in their vehicles until they were freed by emergency crews from the Vienna and Linkwood volunteer fire companies. Marjorie MacSorely was transported by State Police helicopter to Peninsula Regional Medical Center in Salisbury. Kathy MacSorely was transported to Peninsula Regional Medical Center by ambulance.

Myers was transported by State Police helicopter to the University of Maryland Shock Trauma Center. All three persons are reported to be in stable condition.

The State Highway Administration responded to the scene to assist with traffic detours and lane closures. Traffic was diverted through Vienna until about 5 p.m., when the roadway was reopened.

The crash is being investigated by members of the Maryland State Police CRASH Team who will conduct a detailed reconstruction of this collision.

Police say the speed the trooper was traveling prior to the crash has not been determined and will be part of the ongoing investigation. It is not known at this time if the emergency equipment on the patrol car was activated.

Dorchester County State’s Attorney William Jones has been notified about the crash. Police say that when the crash investigation is complete, it will be forwarded to Jones for review regarding charges.

Train carrying chemicals collides with a car.

Firefighters say a train carrying chemicals collided with a car in suburban Washington but did not spill any of its cargo.

Prince George’s County fire officials said the collision occurred about 6:15 a.m. Sunday in Beltsville between a 70-car CSX freight train and a car. They said the tracks are below street level and the unidentified driver was injured when his car left the road and went down an embankment.

The driver was able to escape the car before the train struck and was reported in serious condition at a local hospital, where he was treated for trauma to the upper body.

Police are investigating the crash.

Negligence must not only be asserted but proven if the party claiming to have been hurt is to win the case. To prove negligence the party bringing the action must show that a “reasonable man” would not have behaved in this fashion and therefore the defendant is liable. In this case we have an injury to a man who is in a car hit by a train. The question becomes who is at fault? the driver or the train? If its the driver of the car is at fault (negligent) then his negligence prevents his recovery. This is called contributory negligence. Once the defendant (the train) shows the plaintiff the driver was negligent He will get no money for his injuries.
